How to report content on Azelify that infringes your copyright, and how to dispute a removal.

In short

If content hosted on Azelify infringes your copyright, send us a notice with the six items listed in section 2 and we will act on it. If your content was removed and you believe that was wrong, section 4 is how you say so.

1.Our position

Azelify is a tool customers use to make and publish their own advertising. We do not review what they upload before they upload it, and we do not claim ownership of it. When we are told that something hosted here infringes someone's copyright, we act.

This page describes the process we follow. It does not claim registered designated-agent status under the DMCA — that registration has not been made, and we would rather tell you that than imply a protection we do not hold. The process below works regardless.

2.Sending a notice

To report infringing content, send us a written notice that includes all six of the following. A notice missing any of them will slow things down while we ask you for it:

  • Identification of the copyrighted work you say has been infringed, or a representative list if there are several.
  • Identification of the material you want removed and enough detail for us to find it — a direct link is best.
  • Your name, postal address, telephone number, and email address.
  • A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act for them.
  • Your physical or electronic signature.

Send the notice, with "Copyright notice" in the subject line, to [email protected].

3.What we do with it

We review every notice we receive. Where a notice is complete and the claim is credible, we remove or disable access to the material, and we tell the customer who posted it what was removed and why, giving them a copy of the notice.

We may decline to act on a notice that is incomplete, that targets material clearly covered by fair use or another exception, or that appears to be an attempt to suppress criticism or competition rather than protect a work.

4.Disputing a removal

If your content was removed and you believe it was not infringing — because you hold the rights, because the licence covers it, or because the use is permitted by law — send us a counter-notice. Include the material that was removed and where it was, your contact details, a statement under penalty of perjury that you believe it was removed by mistake or misidentification, and your signature. If the complainant does not pursue the matter, we will restore the material.

5.Repeat infringers

We terminate the accounts of customers who repeatedly infringe. What counts as repeated depends on the circumstances, but a pattern of valid, unanswered notices against one account will end it.

6.False notices

Knowingly misrepresenting that material is infringing carries legal liability, including for the costs and legal fees of the person whose content you had removed. Do not send a notice about content you do not hold the rights to.

7.Trademark complaints

Copyright and trademark are different things, and this process covers copyright. For trademark matters — including use of Azelify™ itself — see the trademark section of the Terms of Service, and write to us with the mark, its registration or claimed rights, and where you believe it is being misused.
